A special court looking into the 1993 Mumbai serial blasts Tuesday asked actor Sanjay Dutt to appear before it Feb 23 for a final decision on his application seeking probation for good conduct.
The 48-year-old actor has urged for leniency under the Probation of Offenders Act before the special Terrorist and Disruptive Activities (Preventive) Act (TADA) court that had convicted him in November 2006 for possessing illegal weapons but absolved him of terror conspiracy.
Sanjay's senior counsel V.K. Manohar argued that the actor was not a terrorist and that he had voluntarily acquired the weapons for self-defence and security of his family.
The defence lawyer also requested the court to ask the probation officer to place its report on Sanjay Dutt during his 16-month imprisonment and also the period he was out on bail.
Opposing the pleas, special public prosecutor Ujjwal Nikam said Sanjay was not entitled to probation under the act because he already possessed licensed weapons before acquiring the AK-47. He added that an AK-47 was not a weapon for self defence and was illegal according to law.
Under the Arms Act, Sanjay faces five to 10 years' punishment. The actor, who already possessed licensed pistols, had acquired an AK-56 allegedly from mobster Abu Salem's aide Ibrahim Mussa in January 1993 as he thought he needed self-protection.
He was arrested in April that year, a month after the blasts rocked Mumbai. Sanjay has spent nearly 16 months in jail in two stretches since then.
The March 12, 1993 serial blasts killed 257 people injured hundreds and destroyed properties worth Rs.300 million.
